Terms of Service

1. Eligibility

You must be at least 18 years old to use Unheld. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into this agreement.

2. Your Account

• Sign-in: Unheld uses Google OAuth for authentication. You are responsible for maintaining the security of your Google account.
• One account per person: Accounts are personal and non-transferable.
• Accurate information: You agree to provide accurate information and to keep it reasonably up to date.

3. What Unheld Is — and Is Not

Unheld is a psychological support companion for people navigating job searches. It is not a mental health treatment service, therapy, counseling, or any form of clinical care. If you are in crisis, please contact a crisis service. In the US, you can call or text 988 (Suicide and Crisis Lifeline) at any time.

4. Acceptable Use

You agree to use Unheld only for its intended purpose and in compliance with applicable law. You agree not to:

• Use the Service if you are under 18.
• Upload or transmit content that is unlawful, threatening, harassing, or defamatory.
• Attempt to reverse engineer or extract source code, prompts, or model instructions.
• Attempt to circumvent Unheld's AI behavior through adversarial inputs or prompt injection.
• Scrape or systematically extract data from the Service by automated means.
• Use the Service to train or develop any AI model without our written consent.
• Resell or commercialize access to the Service.

5. Content You Provide

• Your content: You retain ownership of the content you submit to Unheld.
• License to us: By submitting content, you grant Unheld a non-exclusive, royalty-free license to store, process, and transmit your content solely to provide the Service. This license ends when you delete the content or close your account.
• Your responsibility: You are responsible for the content you submit.

6. Payments

• All plans are one-time purchases of a fixed token balance. There are no subscriptions, no recurring charges, and no expiry dates.
• We do not store your payment method between purchases.
• All purchases are final and non-refundable, except where required by applicable law. If you believe a charge was made in error, contact legal@unheld.ai within 14 days.
• Payments are processed by Stripe. We do not store your payment card number.

7. Intellectual Property

The Service, including its design, software, prompts, AI architecture, and branding, is owned by Unheld, Inc. These Terms do not grant you any rights in Unheld's intellectual property except the limited right to use the Service.

8. Third-Party Services

Unheld is powered in part by Anthropic's Claude API. Your use of Unheld involves transmission of your conversation content to Anthropic's infrastructure. The Service also integrates with Google and Stripe. Your use of those features is subject to their respective terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI RESPONSES WILL BE ACCURATE, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC NEEDS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNHELD'S TOTAL LIABILITY TO YOU WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO UNHELD IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless Unheld, Inc. from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

12. Termination

• By you: You may delete your account at any time from Settings → Account → Delete account.
• By us: We may suspend or terminate your account if we believe you have violated these Terms.

13. Dispute Resolution

Before initiating any formal proceeding, contact us at legal@unheld.ai and give us 30 days to resolve the dispute informally.

If informal resolution fails, disputes will be resolved by binding individual arbitration under AAA Consumer Arbitration Rules. You waive any right to bring or participate in a class action.

You may opt out of arbitration by emailing legal@unheld.ai within 30 days of first accepting these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware and applicable United States federal law.

15. Changes to These Terms

If we make material changes, we will notify you by email and update the "Last updated" date. Your continued use constitutes acceptance of the changes.
